You confirm that you:

  • Are authorized to represent your company

  • Agree to comply with these Terms


3. Payments & Billing

  • All fees are communicated before engagement.

  • Payments are processed through Stripe, Razorpay, PayPal, Wise, bank transfer, or other authorized processors.

  • All payments are non-refundable, unless explicitly stated otherwise in a written agreement.

  • Chargebacks or unauthorized disputes constitute a breach of contract.

  • Failure to pay may result in suspension of services.


4. Client Responsibilities

To deliver our services, you agree to:

  • Provide accurate information

  • Grant necessary access to tools/platforms

  • Respond in reasonable timeframes

  • Follow relevant laws

  • Maintain account security

Strict Access Requirement

We are not responsible for delays or failures caused by:

  • Revoked access

  • Incorrect login details

  • Delayed client responses

  • Incomplete information


5. Results Disclaimer

We use proven systems, but results depend on:

  • Industry

  • Ad spend

  • Operational readiness

  • Market conditions

  • Platform algorithms

  • Client responsiveness

We do not guarantee any specific financial results.


6. Intellectual Property

All automations, frameworks, workflows, SOPs, strategies, and deliverables remain Peak Engage’s intellectual property unless otherwise agreed.

You receive a non-transferable license to use them for your own business only.

Reselling, redistributing, or sharing them is prohibited.


7. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for lost profits, lost data, indirect damages, or business interruptions.

  • Our total liability is limited to the amount you paid in the 30 days preceding the claim.

We are not liable for:

  • API failures

  • Platform outages (Google, Meta, Zapier, etc.)

  • Algorithm changes

  • Bans or account restrictions imposed by third-party platforms


8. Indemnification

You agree to indemnify Peak Engage against claims arising from:

  • Your misuse of services

  • Illegal or non-compliant content you provide

  • Third-party platform violations

  • Breach of these Terms


9. Termination

We may terminate or suspend services if:

  • Payments are overdue

  • Required access is removed

  • You violate these Terms

  • Fraud is suspected

Fees already paid are non-refundable.


10. Third-Party Tools

Our services rely on external platforms (e.g., Zapier, Make, Google, Meta, CRMs).

We are not responsible for:

  • Outages

  • API limitations

  • Platform bans

  • Feature removals

  • Pricing changes


11. Confidentiality

Both parties agree to keep all non-public business information confidential unless disclosure is required by law.


12. Governing Law & Dispute Resolution

These Terms are governed by the laws of Tamil Nadu, India.

Any disputes will be resolved through:

  • Binding arbitration in Tamil Nadu, unless otherwise required by law.


13. Changes to These Terms

We may update these Terms anytime.
Continued use of our services constitutes acceptance of the updated Terms.
